Legal Question in Immigration Law in New Jersey

marriage between a permanent and a french

I am a French Citizen and had a little girl with a lawful permanent US resident. I came in the US several times under the I-94W visa. Can we get married in NJ the next time I will come in the US? And then, can I change my status to permanent? I have many employment suggestions.

Thank you for your help.

Marry? Yes. Become a permanent resident? It would take about 5 years and you would not be able to get the visa here unless you become a U.S.

citizen. Once you have U.S. citizenship, it will be a quick case and you could do it in the U.S.

I suggest that you see or call my U.S. immigration colleague in N.Y. to discuss the details.

Re: marriage between a permanent and a french

If you enter on the Visa Waiver Program (I-94W), then you cannot change your status in the U.S. If you are entering solely for marriage, then you are not eligible to enter under the Visa Waiver Program. If you enter for marriage but say that you are entering for other reasons, then at your adjustment interview, you could be denied for committing fraud and placed in removal proceedings. You should look into whether you are eligible for a K-1 fiance visa. It may take longer, but it could save you from the delays caused by not acting within the law.

You cannot marry or change your status under the visa waiver program. You have other options though. You can email me for a consultation appointment to discuss your options.
