Legal Question in Immigration Law in New Jersey

Getting married

My fiance is in the process of getting divorced we would like to be married as soon as this is final we are living together now and he has legal papers to work he pays taxes and maintains a legal drivers license. Can his ex have him deported or take away his privlages when the divorce is final. We were engaged aprox 11months ago and he is fearful that he is going to have problems with her. What can i do to make sure we are not seperated. Can she have his documents taken away once the divorce is final? Am i able to apply for residency for him prior to our marriage?

Re: Getting married

I agree with the previous response. So long as he has his green card he should be fine. However, I would want to know whether the green card was permanent or conditional as he will have to explain the divorce if it was conditional. As long as the marriage was legit then we could assist you in maintaining his status and filing any additional documents that may be necessary. Feel free to contact me if you have any further questions.

Re: Getting married

If he has his "green card," he shouldn't have to worry about anything from his ex unless she claims and proves the marriage was fraudulent.
