Notice to be Deported

I was very foolish I let my work Visa exprie about four months ago and I received a notice that I was going to be deported back to Columbia.

Last year I got married in New Jersey and now I am afraid they will deport me. What can I do to help myself get my visa back and then to become an American Citizen.

Dear Sir,

If you have received a document called "Notice to Appear," you should consult an experienced immigration attorney to discuss your options. Depending on how you entered the country (i.e. on a valid visa or entry without inspection), you may or may not be eligible for adjustment of status based upon your marriage to a U.S. Citizen. Has your wife filed an I-130 relative petition on your behalf? That should be done as soon as possible if you haven't done so already.

Depending on the specific facts of your case, an immigration lawyer should be able to assess your situation.

You must find local legal representation [lawyer] for your hearing. S/he may be able to get a "stay" on the basis of your marriage to a USC provided s/he has submitted a spousal petition on your behalf.

Dear Sir,

In order to be placed into removal proceedings you must have been served with a Notice to Appear. Due to your potential marriage to a USC you may still be eligible for adjustment of status.
