Paystubs required for H1 transfer
Hi,
I got H1B through a local consulting company in march last week and it is valid till 2009.I did also apply for a SSN and received the same 2 weeks back.I was applying for jobs and now came across a full term job position with a big firm which need H1B transfer.But I was told I would need atleast 2 recent paystubs for H1b transfer.It has not been 2 months I received my H1b from my employer.In that case do I need the recent paystubs for H1 transfer?

When transferring H-1B employers, the USCIS usually does request proof that you are currently working for your H-1B employer and thus are in status. If you have one pay stub or other proof that you are currently working for your H-1B employer you could try to use that as sufficient proof and then supplement it if you receive a request for evidence, or wait a few weeks until you get your next pay stub before trying to transfer H-1B employers. It is advisable to seek advice from a reputable immigration attorney when transferring H-1B employers or transferring to another status as you do not want to risk falling out of status.

The requirement that one submit pay stubs is to prove that one has maintained status. If you only have a few weeks of pay stubs due to the short period of employment, this should be satisfactory.

Paystubs are required to ensure that you were in valid H-1b status. I would say 2 paystubs is sufficient and probably the minimum. Possibly try to get paid on a bi-weekly basis to get more paystubs.
It is better to remain at the initial company for another month than get the H-1b transfer and possibly fall out of status.
