Legal Question in Immigration Law in New Jersey

Question :Priority Date

Hello-

I have filed my GC through EB3 with priority date Apr,2002. My I-140

and I-485 are filed concurrently as of July, 2005 and my I-140 is

approved. Since the priority date for EB3(India) is in May,2001, I asked my

lawyer if there is any other creative possibility to accelerate my green

card processing (like reapplying with retaining my originial priority

date under EB2). My lawyer told me that the priority date is relevant

only for the I-485 application and USCIS does not wait for the priority

date to become current for the actual approval of I-485. This is

contracdictory to what I read in the internet sites about priority date.

Could you clarify this issue for me?

If the priority date, indeed, matters for the approval of I485, are

there any creative possibilities that I can consider for acclerating my

green card approval.

Can you please email the details?

Re: Question :Priority Date

No there are no other possibilities. Only way you can accelerate if you reapply under EB1 category showing that job and your qualification entails that.
