Legal Question in Immigration Law in New Jersey

Two suggestion

Dear Sir,

Our k1 visa petition under 221(g) for more than 16 months,

They say that the consulate will contact you once the administrative process are over,

For almost 16 months we got the same reply like this,

i am holding a blue paper under us law 221(g) stating that my visa petition requries further adm processing and once the process are over,this office will contact you

However all of a sudden, the Chief IV,Section says that our petition has been purged from the system and suggesting to go for I-130 for CR petition

whereas the consular who took our interveiw says that it is still under adm process and once it is over he will contact me

we do not know what to do now?

we are planning to go for our marriage outside US and apply for I-130

why this is happening to us sir ?

Two very important and competent us offcials giving two different kind of directions

whose words we shoudl consider ?

Pl help us to over come this tension

My US Citizen fiancee already suffered a stroke which left her right hand side paralized and i want to be with her as early as possible to take care of her,

Dear Sir,

Unfortunately, you are most likely being affected by a recent change in the procedure of K-1 visa processing as a result of the Internation Marriage Brokers Regulation Act. As a result the USCIS has sent out 10,000 requests for evidence from individuals who have applied for K-1 processing.

Unfortunately, government officials cannot always provide the answers needed to make a competent decision on how to proceed. It is advisable to discuss your matter with an experienced immigration attorney before moving forward and deciding which process to pursue in light of your personal situation.
