Legal Question in Immigration Law in New Jersey

temporary marriage-based green card

Hi, my name is marina; recently I have lost my temporary marriage-based green card which expires next year ; but i have been married to my husband for 2 years and 1 month already. My question is: if i should apply for a new green card, will they replace it with the same temporary one or give me a 10 years(permanent one). Thanks for your help.

Re: temporary marriage-based green card

They'll replace it but you should get an attorney to help you out here. I can refer you to a good one if you would like.

Re: temporary marriage-based green card

Marina, it is a little more complicated. You are a conditional permanent resident and you have to remove your condition prior to a 2 year anniversary of your residenship, not 2 years of your marriage. The lost card will be replaced with a temporary card again. And you will have to go through the Removal of Condition procedure to get a permanent one. Please note that replacement of the card may take up to 3-4 months. If you have any further questions, please contact me directly at [email protected]
