Legal Question in Insurance Law in New Jersey
Beneficiary information
My father passed away suddenly in January. A few weeks ago my siblings and I received a letter from his attorney informing us we were beneficiaries (along with his 2nd wife) on his insurance policy. We were not aware that he had us as beneficiaries. They requested we each fill out the information and mail it back to their law firm as opposed directly to the insurance company. My brother dropped his off in person the other day and he was told by someone in the office that we would not be receiving the entire amount because our mother (his first wife)is suing his estate for years of unpaid alimony. This law suit was also in progress before my father died. I am furious. Do they have the right to do this. We have nothing to do with this law suit. We are all grown adults, not minors. And, shouldn't the insurance company be mailing the money directly to us, not the law firm?

While I can not be certain, based only on what you have written, I do believe you are correct. The insurance policy may very well be payable directly to you, and therefor not belong in his Estate, and not subject to claims against him.
