Legal Question in Insurance Law in New Jersey
Where can I file suit?
I am a NJ resident; my car was hit
by a driver running a red light. She
is also a NJ resident and the
accident occurred in NJ. She is
covered by an insurance co. located
in PA. After first making a
reasonable offer for my totalled car,
they then said that offer was a
mistake and made a 2nd offer of
less than 20% of the NADA book
value of my car. I think I will have
to sue them; can I file suit in a NJ
court?

Re: Where can I file suit?
You can't sue the insurance company. Even though it is the insurance company that will eventually have to pay, you will have to sue the owner and driver of the vehicle that hit you. That will get the insurance company involved. You should bring the lawsuit in New Jersey.
