Legal Question in Insurance Law in New Jersey

Liability for childs negligence in a motor vehicle accident

A 17 year old (minor) licensed driver, driving the parent's car, is found at fault in a motor vehicle accident (MVA). The insurance policy has a threshold, the victim looses his career, because of the accident. An economists values his monetary losses at more than double the insurance policy (this does not include pain and suffering). On the documents the child and parent are listed, of course the parent owns the policy and car. Is the parent liable or just the child? It was the parents car and insurance policy, but the car was operated by the child.

the parents insurance covers the car, therefore it covers the claim. If the claim is excess of the poicy, the parents must have been found to be negligent in order for the laintiff to recover formt he parents. You need a lawyer to handle this as it could get delicate.
