Legal Question in Insurance Law in New Jersey
Cannot prove I am sole beneficiary to brother's insurance.
My brother was a mildly retarded man with poor reading skills. He worked at an Atlantic City Casino for many years. He was a member of H.E.R.E.Union Local #54 and his beneficiaries are entitled to a $10,000 insurance benefit. My brother listed as beneficiary me, our father (deceased), our grandfathers (both deceased) and our other brother (deceased). I am the only one left. My brother was never married and had no children. When he made out insurance form, I am sure he did not understand what a beneficiary was. They probably told him to put ''family members.'' One of the grandfather's he listed died in 1934, so I know he did not understand. My brother died in January 2002. For over a year, I have tried to get death certificates for our late brother and one grandfather, both of whom died in NJ. The searches keep coming back that they are unknown. I have the death certificates for our dad and the grandfather who died in 1934. How can I prove that I am the ONLY LIVING beneficiary and collect the insurance I am entitled to?? My problem seems to lie with the inept record keeping of NJ. The other death certs. came from PA and came right away. Oh, I had no luck with the Social Security data base either.

you need to go to the county where youtr brother died. Go to the probate of wills dept. and they will help you straighten out the mess.
