vehicle hit no police what can we do

Our vehicle was hit with someone backing out onto a semi major road in my town. No damage to the other car but my young driver daughter did not notice the extent of damage to her vehicle. She did not call the police.The driver says it was her fault. I say impossible as she was hit near the back...she was driving straight his house in on the left hand side of the road an d he backed into her lane Do we have a chance. what should we do. I'm guessing 500 at least in damage maybe more
