workman compensation
i work for a painting company that sub contracts some of the jobs out. are the subcontractors required to have workman compensation. what is our liability if they do not have it.

A company could be charged a premium for coverage to employees of uninsured subcontractors. All agreements should require subcontractors to carry insurance and produce evidence of insurance. All contracts should have reps and warranties to ensure the currency of all forms of insurance and reserve rights to audit for compliance. If existing agreements do not have these requirements, the contractor should seek amendments of the agreements with appropriate releases.
