Legal Question in Intellectual Property in New Jersey

Busi plan prior to a lwayer or after?

Hi,

Referring to my previous question ( http://money.cnn.com/2006/08/07/pf/deals_cars_0609.moneymag/index.htm), should I hire/consult with a lawyer prior to the completion of my business plan or after? Will having the business plan help the lawyer decide if I am infringing on the existing patent?

Thanks in advance.

Hi,

You should probably consult with an attorney while you are developing your business plan so that the attorney can help you to avoid an infringement situation.

As a sound, general rule, you should ALWAYS consult with an Attorney BEFORE the fact, rather than after the fact, if you truly want to be properly advised of your rights before spending far too much money to turn back per se. Its far less expensive to do your due diligence beforehand, that face modification costs and/or lawsuits for not prudently researching everything ahead of time. So, with this in mind, given your situation you are facing, you should contact an Attorney ASAP during your business plan development stage and make sure you take the necessary legal precautions before its too late or too costly to turn back.
