Legal Question in Intellectual Property in New Jersey

Copyright of Ideas

I am starting a consultant business and have developed a quality assurance work process for insurance companies. I've also developed an anocronym for the pronciples opf this work process. Must I go through a formal process to copyright the acronym and the process or can I just state in promotional materials that it is copyrighted?

You automatically have copyrights to your work, once you have written it up. But you would need to trademark the acronym and possibly patent the method you have created. Let me know if you want help with this work.

Ideas, concepts, and processes cannot be copyrighted. Those items are potentially patentable.

If you are looking to protect an acronym, the type of intellectual property protection is a trademark. Trademark rights arise through actual use of the mark in commerce, not by registration, however federal registration of a trademark provides the trademark owner with significantly more rights to protect the mark.

If you using the acronym in commerce, you are free to use the "TM" symbol after the mark to indicate that you are claiming trademark rights in the acronym, but the designation is not required.

You want to register a trademark - Federal if you will use the mark in more than one state.
