Adverse employment actions motivated by gender violate both Title VII of the Civil Rights Act and the New Jersey Law Against Discrimination. A common difficulty is proving the causal connection given that there are frequently plausible business reasons for doing things like adjusting employee hours. Additionally, given the privacy in which many employee counselling situations occur, what exactly was said is frequently difficult to prove. If you can overcome these difficulties and if the adverse action happens, you may have a case.
