Legal Question in Employment Law in New Jersey

My boyfriend is an employee at a very small company (he is the only other "real employee" other than his boss / owner). others are consultants.

My boyfriend has a written agreement that he is to be repaid for the $ he outlays for his

health insurance - which is approx $450 a month.

The company has not been doing well financially. Me boyfriend is owed approx. 7 months of health insurance reimbursement at this time. (over $3,000).

The company's phone service was already turned off for non-payment. and there was talk of layoffs this past February (some of the consultants took big pay reductions to remain on).

What happens if my boyfriend get laid off BEFORE his boss pays him the $$$ owed for his

health insurance reimbursement? How can he protect himself? Other things are going on in his life right now (car troubles, etc) where he really needs this $ reimbursed to him as origainlly agreed in writing.
