Legal Question in Employment Law in New Jersey

my boyfriend worked at a coffee job for a year, and he decided he didnt want to work there anymore. after being terminated from the jobs for 4 months he hasn't received his last paycheck. Is it illegal that the employer has yet to mail out his last check? I have been notified that they have it. his mother even contacted the owner and she just confirmed the fact that they have it, but still refuse to send it out. weird huh?
