Legal Question in Employment Law in New Jersey

Breach of Contract?

The school contract (foreign school, contracts governed by the laws of the State of New Jersey) states that the employer will, by December 15, notify teachers whether or not they will be employed next school year; if they are, they will be given a copy of the new contract for consideration. By December 31 (or agreed later date) we must sign and return the contract, or resign.

This (school) year, new contracts were delivered to other teachers late on January 4. A colleague was told just before the end of the day that his contract would not be renewed.

He had had no indication that his future employment was in doubt. He had missed his chance to sign up for recruitment fairs (application deadline December 31).

Is this breach of contract? Is he entitled to compensation? Other?
