breach of employment agreement due to no pay
Hello All,
I joined a company in NJ and they verbally promised me to pay 70% of billing amount which they paid but didn't pay anything in my initial bench period of one month. After 3 months of project i was again supposed to be on bench so i left and joined another company in MA. Now my previous employer has sent a notice of employment breach since i didn't work with him for 18 months and I have to pay $ 14000 for not working with them for last 14 months of employement agreement. They charged me the fee for filing H1b visa has $2000 in year 2006. So do i need to pay them $14000 ?

I am currently handling several cases against an employer who is doing similar things. (It may be the same one.) You probably have good defenses to their claim and may find that they owe you money as well as the benefit of the remainder of your agreement with them.
The employer is not supposed to "bench" you if you are on an H1B visa. Unless there is something unusual about your situation, the employer may have made false representations to the U.S. government.
