Legal Question in Employment Law in New Jersey
Changing hours punched-in
Is it legal for my employer to change the times I punch in and out? I usually punch in about 15 minutes early, and never take a full hour for lunch. My employer always changes my times (in the computer system) to make it appear as though I always clock in and out at the exact same time, If all of the time I worked was calculated correctly, I should be earning over-time, but he alters the time punches to reflect exactly 40 hours of work each week.

Generally it is NOT legal for your employer to do that, but it really depends upon the facts and where you work, what you do, etc. Feel free to give our offices a call: 267.639.3105.
