Commission / bonus

My company is witholding my commisson check / bonus check due to a company account balance.it is a commission check it is based on employee sales goals we reach 12500 in profit dollars and recieve 5% of all money over that and we get a bonus kick of 5% if all sales reach their goals. my company calls it a bonus to their own admission so that they can treat it as such and not be forced to pay money to employees who quit or get terminated.Is this legal and if not how do i handle it?

If your NJ employer has not paid you money that is due on account of wages or salary (including commissions), you should first report the matter to the NJ Office of Wage and Hours Compliance of the NJ Dept. of Labor.
