Legal Question in Employment Law in New Jersey
The company I have worked for for 15 years was sold 9/30/11. I was informed that I would be a consultant and my salary cut 38% and I would be paid 2x monthly on the 1st and 15th. I only received one "late" paycheck on 10/25 to cover the first half of Oct. I followed up with email and phone calls about not being paid for the last half of Oct. and travel expenses, etc. On 11/11 my new employer called and told me he was "letting me go" because he could not afford me. Now he wants all the client files, etc. sent to him and said he would negotiate payment after I returned all company items... What recourse do I have? It would be costly to mail everything and I doubt he wants to pay me my vacation, salary, remaining expenses, etc.

I think that you should consult a lawyer before returning anything. However you do not want to risk becoming liable for misuse of the company's confidential information. So, do that quickly. You may very well have a claim agains the new employer and possibly the former employer depending on your arrangements.
