Legal Question in Employment Law in New Jersey
For a contractual dispute with a company A, we have reached to a settlement to pay money for the damages to company A. The company A's lawyer is asking us to deposit the money in his Trust Account than directly paying to company A. Is it safe to deposit money to Lawyers trust account? Is it finally going to reach Company A?
1 Answer from Attorneys
It is the usual and customary practice for settlements to be made through the plaintiff's lawyer. Among other things, that helps to ensure that the law firm gets paid. If you send the money directly to the other party, you can be liable to pay the lawyer's fee if the other party does not pay. So, as a general principle, it is safer for you to make the payment through the lawyer.
