Legal Question in Employment Law in New Jersey

Employee Pension Benefit

My former employer, the AIG Life Insurance Company, incorporated in DE, refuses to begin payment of my Pension Annuity Benefits, because my wife will not submit proof of her date of birth.

I live in NJ, am 66 years old and became eligible for the retiree benefits at age 65. My wife is 62. We are married but not living together. I have applied for the default Joint and 100% Survivor benefit with my wife as beneficiary.

I provided my wife's DOB when i was hired in 1995.

I do not believe they have the right to deny my benefit simply because of her non-cooperation in providing prove of age.

Re: Employee Pension Benefit

Adk your lawyer about filing suit against AIG to force them to begin payments and to pay retroactively to the date of application. Subpoena your wife to give her deposition. Have her bring her birth certificate or other evidence of age. Any way that works out, you will get the evidence and your pension.
