Legal Question in Employment Law in New Jersey
Employer not holding to contract
My employer was brutally cruel the CEO would curse at everyone on a daily basis and the environment was terrible. I am pregnant and the stress of this job was not healthy for me at all. After a day of being screamed at I got a call my daughter was sick I had to take care of her. I then left on an approved unpaid vacation to visit my husband before he deployed. My employer did not pay me for the hours I had worked the week before and posted my job on monster. We came to an agreement in email that as long as they gave me my final paycheck, my bonus and did not fight the unemployment claim I would not hire an attorney. They paid all of the money but have chosen to fight my unemployment. Since I have this in writing do I have a leg to stand on.

Re: Employer not holding to contract
Based on what you wrote, it appears that the email (or series of emails) may have created a binding contract between you and your former employer. It also appears that your employer breached that contract by fighting you application for unemployment. Therefore, you may be able to sue for wrongful termination. However, a review of the exchanged emails would have to be brought to an employment attorney to review.
