Legal Question in Employment Law in New Jersey

Employment Law

I am an exempt employee in New Jersey - my profession is sales. I resigned on October 1st. Gave two weeks notice that my last day would be October 15th. They walked me out the door shortly after I resigned at 11:45. I have paid 1/2 of my monthly benefits contribution but I got a note from HR stating that my coverage will end of October 1st. Shouldn't my benefits last until October 15th? They are not going to pay me for the two weeks notice... but they do owe me for October 1st - right? Thank you.

Re: Employment Law

It depends on your specific employment situation. If you have indeed purchased benefits from salary deductions, you are entitled to those benefits. If, on the other hand, you are being charged for contributions to a plan that is contingent on your employment, then the benefits will end when your employment ends unless the plan provides otherwise. In that case, you are entitled to a refund of your advanced contributions. See also: COBRA.
