Legal Question in Employment Law in New Jersey

employment question

I am working at a warehouse and driving a non CDL truck for a rug company. When I was hired the boss told me I would be getting paid $500 a week net pay and he will pay the taxes. It is salary. I started 4/21/2008 and so far I have worked 63 hours in 1 week. One day I worked 15hours and another day I worked 18hours in the same week. Am I supposed to get overtime pay for any hours over 40 hours a week?

Re: employment question

If you are non-exempt (and you are), your New Jersey employer must pay you overtime pay for any time worked in excess of 40 hours per week. Time cannot be averaged from week-to-week in computing overtime wages. There is no restriction on daily time. That is four ten-hour days is a 40 hour week with no overtime.
