My first question is whether your rights under the Americans With Disabilities Act may have been violated. If your illness is such that you could have done the work with reasonable accommodations and you asked your employer to make those accommodations, then you may have a claim outside of your unemployment claim. As to the unemployment claim, you are entitled to appear and give testimony to answer an appeal. You can obtain records from your employer if they would be helpful. You can also be represented by an attorney of your selection. The State will not pay for your attorney. To be heard in the appeal, you should follow the instructions on the forms that you receive from the Department of Labor.
