Legal Question in Employment Law in New Jersey

Forced to Quit

I was working for a major brokerage firm who has always said positive things about me in my reviews and ever since the market has declined, they started to deliberately find things wrong just so they can fire me so they wouldnt have to lay me off. I've been a strong performer there things have not been an issue since the announcement of lay offs came about in May. Now, my company has just merged with another scheduled to take place in January so things had gotten far worse. Now, I resigned on Oct 14th. I've always brought in some documentation whenever I have been out to show that I wasn't home fooling around. But ultimately brought my attendance up to be a terminable issue. I was in a car accident which caused me to be out 4 days, I had surgery which caused me to be out 5 days, and some more sporadic medical issues, not to mention my grandmother who I live with, being in the hospital. Ultimately, they put me on a final warning and I chose to resign. In addition, to add to things, they claim they overpaid me (for a month I received pay) since they put the termination in late. They are forcing me to pay them back and now with this horrible market, I have no money. They've continually affected my life negatively. Could I sue?

Re: Forced to Quit

This sounds as if you have two major issues: First, your employment discrimination issue based upon a possible disability. Second, your car accident. Definitely give us a call as soon as possible to discuss both. We handle both motor vehicle accidents ("MVAs") and discrimination cases. Give me a call on my direct line: 267.639.3105.
