Legal Question in Employment Law in New Jersey
franchise liability
husband worked for a sears franchise. Sears took the franchise away from owner. Owner owes husband approx 3,000 in back pay and expenses. also with held taxes and never paid to government. Owner has no assets and apparently in drug rehab. Sears says they have absolutely no resonsibility to us. Is this true and if not, what can we do?

Re: franchise liability
The answer to your question (Sears responsibility) is going to depend on the exact nature of the relationship between Sears and your husbands employer. A full review of the facts is necessary before anyone can give you a competent answer.
With that said, there are a few theories of recovery which are available in most wage collection cases and would most likely be available to your husband as well.
If you decide to pursue this matter further, I suggest that you contact an attorney (either me or someone else) with experience handling wage collection cases.
I would be happy to discuss this matter with you, my initial consultation is free.
