Legal Question in Employment Law in New Jersey

Hi my name is Jack. I worked for Sears as an assistant store manager. At the time, I was a salaried non-exempt employee. Sears said that the overtime hours I worked for the past 2 months before I resigned, I was only qualified for 0.5 time of the my hourly rate instead of 1.5 time. Was it legal for Sears to pay an associate like that? Please help.

In New Jersey, non-exempt employees must be paid overtime for all hours worked in excess of 40 hours in any work week. The minimum rate for overtime is 1-1/2 times the base rate. /p/ See also: http://info.corbettlaw.net/lawguru.htm
