Legal Question in Employment Law in New Jersey
labor and employment
I left a job because I was salaried and had to be on telephone call 24/7. I went back to the job 6 mo later, after receiving an e mail from the HR director stating that she knew how important family life was for me and I would not have to be on call 24/7 and it would be worked out when I came back. (I have that e mail from 4/05) When I had never been re-imbursed for any of the time I worked on the phone from home (in time or money) which included 9 hours Xmas day '05 HR said I should have complained to my mgr. I did complain to the 1st mgr and the HR director told me she ''squashed the idea'' and the 2nd mgr promised she was looking into it. Do I have any way of being reimbursed for that time? Also, while working there, I chose to change positions which was to take place in 6 weeks so as to prepare everyone. The next day and before a contract was signed by me agreeing to take the job, the director announced it would take place immediately. I talked to my friend who is also a referral source for them and I was ''let go'' for sharing info with my friend/referral source that my team lost money last yr. The 2nd director told me that wasn't true. They now give bad references as I am looking for another job. What can I do? Thanks

Re: labor and employment
If you have worked time for which you have not been compensated there are both U.S. and NJ laws which state that you are entitled to be paid. In fact, you may be entitled to up to 2 times what you should have been paid (the amount + an equal amount of liquidated damages). Additionally, your employer may be required to pay your attorney's fees b/c of their violation of NJ and Federal law. I handle cases like this on a regular basis.
