Legal Question in Employment Law in New Jersey
LCA & Offer Letter says 65,000
I am a percentage consultant with the firm 80-20. They have paid me in total till dec 2009 and after that they have paid me only partial amounts. Payroll is run bi-weekly and they have run payroll for
Jan ,Feb,Apr,May and they ran only once in March and June. There are partial payments pending that amount to more than 20k. I have tried to reach them by emails /phone and never got a response and their voice messages are full.
What can I do to get my Hard earned money deposited into my account? I have faxed all the approved timesheets to the firm and still they are not paying me. All the other payments that they paid were never on time after Dec 2009 and the payroll was delayed every month.
What options do I have?

You are going to have to pursue them. Exactly how to do that? well, a very forceful letter from an attorney is the first step (you have already done everything to comply with their requirements, you have said), and after that you will need to take legal action.
I would need to know more about them to tell you how I would pursue them for you.
Give me a call, make an appointment to come see me, and let's get moving on this for you.

Please keep in mind that my response is just a general comment on your question, and not legal advice. Your question and any response does NOT create an attorney-client relationship between you and this law firm. The exact details of your situation and things that you have not mentioned in your question can completely change the answer to your question. You can not rely upon what I have written, because I do not have all of the information that I need to advise you, I only have the very small amount of information that you put into your question. For me to give you any legal advice, I would need for you to hire me to be your lawyer, and then we would need to discuss this in detail and go over the documents.
To get legal advice that you can rely on and use, please contact me directly. I would be happy to assist you.
My experience is that when an employer falls so far behind in payments to employees and independent contractors, there is little hope of improving things without legal action. Frequently, this becomes a race to get a piece of the assets before the employer goes under. I have been successful in recovering money for employees in your position is the efforts at collection start early enough. If you want to discuss your situation, give me a call. /p/ See also: http://info.corbettlaw.net/lawguru.htm
