Legal Question in Employment Law in New Jersey
My mother signed a contract with her current employer. It contained a no competition clause which stated if her company lost the contract with the school they were contracted with she could not get employment with the next company that came into the school. She is currently a management employee and her employment will end May 28th unless she finds alternate employment within her existing company. She is 70 years old. She would like to continue working and is comfortable with the school and she would like to seek employment with the new contracted company as a non-management employee (like cashier or something similar).
My question is - if she seeks and gains employment with the new company, what can the current company do to her based on the clause in her current employment contract?

I would need to know a lot more, but it sounds like this no competition clause is not going to be enforced by a Court. Not sure, but it sounds pretty outrageous.
What they threaten her with and what they can actually do to her are two different things.
