Legal Question in Employment Law in New Jersey
Non Solicited
I was working for a company as a Sales rep from 8/13/07 for one year.
Upon hiring I signed an employment agreement indicating basic employment policies.
On July 25 2008 approximately 12 Months later my company provided me a 55 page hand book containing policies Vacation, dress code, sick day, etc.. hand book is dated July 08(1 year later)
My Employer requested a week later from all employees to sign a separate paper indicating
ACKNOLWEDGMENT that I received and read the book . If I did not sign the book revoke in discharge.
I signed this paper . A month later I resigned from the company.
I reviewed this book again, and I was shocked to find on page 22 a paragraph indicating Non Solicited of customers upon termination.
Am I violating this agreement If I contact my customers? I feel that I was duped as this paragraph was buried inside a company handbook.

Re: Non Solicited
Your question is more complex than it seems. Two things stand out: (1) The employee handbook may not be binding on you for several reasons; and (2) even so, you may have a legal obligation not to steal your former employer's customers. For an opinion that is more tailored to your situation, you should consult a lawyer.
