Does disparate treatment during term of employment bar en employer from suing to enforce a non-compete agreement?

If you have an employment contract, then it is possible that you can claim that your employer breached its contract with you by discriminating against you. However, without reviewing your employment contract and the non-compete agreement, I cannot provide you with more information. If you do not have an employment contract, then an attorney would look to see if you have entered into an implied contract with your employer.
