Legal Question in Employment Law in New Jersey

I was overpaid by my employer

As of Jan 1, my salary should have decreased due to a decrease in weekly hours worked. My first 2 checks of the year were accidentally paid at my 2005 rate. The first went unnoticed by me since taxes kicked in again, and my net was lower. After the 2nd check, I realized that my salary had not been changed. I will tell my employer of the error - can they take back all of the overpaid money out of my next check? Do they have any obligation to work with me since it was their error?

Re: I was overpaid by my employer

They can not take it out of your pay check without your written permission.

Explain the situation, I am sure they will be willing to take it back over several paychecks.
