Legal Question in Employment Law in New Jersey

retro pay rights

I worked at a local township and recently got a new job with the state in Oct. 2006. When I left we were in contract negotiations. I was paying union dues, until I left. We started contract negotiations back in 2005 but workers didn't receive retro pay or raises until 2007. Tried talking to union rep., but said i have no rights. Spoke to other people in same situations, they received money. They were told they don't have to give retro, but if everybody else gets it I have rights to it as well. Two other previous coworkers are in the same situation. Know for a fact they receive retro pay(have documentation). Are we entitled to the pay?

Re: retro pay rights

File a grievance. The union will either have to go forward with the grievance or will have to give you an explanation of why you are not entitled to the pay. If you are not satisfied with the result, your grievance procedure may provide you with other rights. If the union will not handle the grievance, you have rights against the union as well.

Trust your intuition regarding your right to retroactive pay. The township is not going to give away what it doesn't have to. Somewhere in the contract or the labor law is a provision that requires (and authorizes) it to pay retroactively.
