Legal Question in Employment Law in New Jersey

Salary question

My name is--name removed-- and I am writing to you on behalf of my wife, Miriam.

My wife was doing Medical Billing for a doctor on a part time basis, earning $30 an hour, and the doctor indicated that he could not afford to pay for more than 30 hours, over a two week period, which my wife adhered to. My wife has been working for this doctor for approximately two months, and she was properly compensated for it.

The doctor, to our understanding, was very happy with her performance, and no issues arose during this two month period.

Last week, the doctor my wife works for, called her into his office and told her that she would no longer be employed by him, and fired her on the spot.

The reason he gave for letting her go was that when he first hired her, he asked her what salary she was making in her previous job, and she over inflated her previous salary.

What I find unacceptable is that he refuses to pay her anything since the last paycheck because he feels she deceived him. My wife put in 30 hours since last paycheck and is owed $900.

Could you please advise as to my legal rights regarding this situation.

Based on what you have written, it looks like the doctor owes your wife for the time that she worked. I would suggest that you contact the NJ Department of Labor to file a complaint with the wage and hour compliance division.
