Legal Question in Employment Law in New Jersey
Supvsr. discouraged me from submitting resume for promotion
I work for a railroad in the northeast. I have two associate degrees and B.A. in history. I have been with the company 2 1/2 years. Recently an asst. suprvsr. position opened and my boss basically told me I would not be considered or interviewed because I had not been there long enough, I really wouldn't like it, he had to check with management etc. After the interviews I find out only four interviewed, two with signicantly less time than me, and one with eleven months more than me (all related to company management). This is not the first act of nepotism in hirings and promotions. What can I do. The Union seems to look the other way, and chalks it up to ''that's how it's always been''. Help!

At this point, my recommendation to you would be to contact an employment law attorney from the New Jersey branch of the National Employment Lawyer Association: http://www.nelanj.org/
An employment lawyer would have to read the company's policies and the collective bargaining agreement and find out who to communicate with in order to (1) find out what criteria is used to select the desired position. (2) if there is any violations with company policy by what your supervisor did, and (3) what, if anything, your union SHOULD be doing on your behalf.
