suspended but required to work

I was recently issued a 3-day disciplinary suspension. The company is requiring me to work those 3 days without pay. Can they do that?

Re: suspended but required to work

For purposes of my answer, I am assuming that your a not a salaried employee.

The short answer to your question is no.

NJ Wage and Hour Law is clear, you must be paid for all hours worked.

By not paying you for hours you are working, your employer is violation of the NJ Wage and Hour Law and the NJ Wage Payment Law.

Keep in mind this answer is based on the little bit of info you have provided. Additional facts / information may change my opinion.

If would like to discuss this matter further, I am available for a free initial consultation. Email me, [email protected] or click on the Attorney Profile link for my phone number.
