Legal Question in Employment Law in New Jersey
I was terminated from my job yesterday 2/8/2010. They said the reason was excessive callouts. I had five callouts during my 9 months there. The first one was because I was in the hospital, have documentation. One was from December 19, 2009 when we had two feet of snow and the other two were this past week when we had another 2 feet of snow. My streets were not plowed and they had suspended all forms of public transportation. I don't remember what the other one was for. There were other coworkers who also called out during these blizzards but on the schedule they were marked as off. I was the only one marked as a call out on the schedule.
I believe I was terminated because I had an issue with my supervisor and called his supervisor to take care of the matter. I called his supervisor on 1/23/2010. After the phone call my supervisor, I believe had already hired my replacement even before he had terminated me. I believe he was just waiting for an excuse. Do I have a case for wrongful termination?

You may have a case of wrongful termination if you were terminated because of your age, nationality, race, sex, disability or whistle-blowing for public health concern or accounting fraud; otherwise, your employer can terminate you for cause or no cause.
