In most cases, the employee must be reinstated under either the NJ Family Leave Act or the federal Family and Medical Leave Act. The most common exception is if the company has a bona fide reduction in force. If there is a question of whether a lay off is legitimate, it is frequently in the employee's interest to challenge it because the successful litigant can also recover attorney fees.
