Legal Question in Employment Law in New Jersey
Unpaid overtime
Hi! My fiance was recently the manager of a place. When he first started, he had difficulty finding help and was working a lot of overtime hours. Toward the end of his employment, which was voluntary, the company, which is a franchise but his is owned still by corporate, refused to pay him overtime pay. They would just pay his hourly rate. Could you please tell me who to report this to? After the district manager told him that he wasn't going to be paid for his extra hours, he didn't put up too much of a fight because he wanted to leave the position, but we still have a family to take care of and I know its got to be illegal to refuse to pay. Thank you!

He can file a complaint with the New Jersey Department of Labor, Wage and Hour Section. Here's the website with information on how he can file a complaint: http://lwd.dol.state.nj.us/labor/wagehour/wagehour_index.html
