Legal Question in Employment Law in New Jersey

Withholding paycheck

Left job, employer withholding last paycheck until uniform is returned. Employer has been told numerous months that uniform company loses then ''finds'' uniforms. Uniforms are never removed from building and are stored in an unsecure room. Can they withhold? Am I obligated to pay for uniform?

Re: Withholding paycheck

Under NJ law, an employer is specifically prohibited from withholding pay for any reason other then as a dispute about the amount due or money actually owed because of an employee loan. In those special cases, only the amount due or in dispute can be held back.
