Legal Question in Employment Law in New Jersey

I was wondering if it's legal for company to state that they are an equal opportunity employer but then also state that a person must pass a background check to be hired? It doesn't seem right that they are discriminating against ex-offenders.

An ex-offender may be barred from a particular type of employment if there is a reason for concern with the underlying past conviction and his/her application for new employment (e.g. former sex offenders are barred from working in public schools and former bank robbers are barred from working in a bank).
