Legal Question in Employment Law in New Jersey

After work behavior

I work in a small union office. The boss, I and a group of guys have been friends for years. Some members of this clique thought it funny to start a rumor about the boss and I having an affair. I was not amused! I now refuse to speak to this one individual.

The Boss insists that I do, claiming that such'' rudness'' would equal termination in a larger company. I believe what i do on my own time-out of office- is my concern only. Excepting moral terpitude or the blatently illegal.

Sounds like sexual harassment (or sexual orientation harassment if the boss is the same gender as you) to me and certainly defamation of character. It would even be a stronger defamation case if either you or the boss is married. You ought to consult with an employment attorney on this matter.

The boss is wrong on all counts. Management in a larger company would recognize the potential of a claim under the LAD and act to counsel and perhaps discipline the offending party. Pressuring you to socialize with the offending co-worker after hours where you have indicated your wish not to do so because of the previous harassment is way across the line.
