Legal Question in Employment Law in New Jersey
Is my work/life balance being violated?
Hello I work for one of the leading cosmetic companies in their manufacturing department. Lately I have noticed that the supervisor has been putting peoples' name on a list to either work late or come into work early. My name was recently put on the list however My wife Recently went back to work after giving birth to our daughter who I care for during the day while she works and I work at night, make it impossible for me to work late of come in early however I can work on the weekends, My name was put on the list and I was unable to come and it was added to another list. I would like to know if this is legal and if it is how do I then establish a work life balance when I have such a great responsiblity, also I feel I should mention the reason for my concern when you fail to show up to this forced OT you will be written up and threatened with termination, a coworkers wife was in a wreck recently and when the worker tried take a day to be at his wife's side he was told he had to come in or be written up. I would hope this is not legal and if it is how can I take care of my daughter and not lose my means of support for my family and I whenm my wife and I do not want to send our infant to a sitter.

If they are forcing overtime on you, or retaliating against you or your wife for her maternity leave, you may have legal options available to you. I know of at least one large NYC cosmetics company with manufacturing in NJ that routinely discriminates against women for taking maternity leave. In your case, punishing you may be a circuitous route of forcing your wife to quit and stay home. If you'd like to meet and discuss your options, please contact me via email to arrange a consultation.
