Legal Question in Landlord & Tenant Law in New Jersey

apartment with a problem

I have an apartment that the sewer backs up every 6 to 8 weeks this problem have been going on since I moved there 3 yrs ago. I am pating 857.00 a month plus 1 month back rent at 300.00 more a month. this problem have never been solved I want to know how legal is this.

I hope you have put this in writing to your landlord as they cannot fix a problem unless they have notice.

It appears you may have a case as a tenant is entitled to what is called a warrant of habitability (essentially somewhere fit to live)

A sewer backup like this would seem to infringe upon your right to enjoy your apartment and may constitute a health hazard, which may lead to health problems for you.

Please contact your landlord (especially in writing if not done) informing him about the problem.

More info is required such as who has paid the sewer bills etc - Depending upon these additional facts you may need to hire an attorney to help you.
